1. Agreement to Terms

By accessing or using Fumbled ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. The Service is operated by Fumbled ("we," "our," or "us").

2. Description of Service

Fumbled is a sports betting analysis tool that processes user-uploaded betting history to provide statistical analysis, performance metrics, and AI-generated insights. Fumbled does not accept wagers, place bets, facilitate gambling, or provide gambling services of any kind.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

4. Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your password
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• One account per person — account sharing is prohibited

5. Subscription and Payments

• Free accounts may upload one bet slip to preview the analysis
• Pro subscriptions are billed monthly ($19/month) or annually ($159/year)
• Payments are processed through Stripe (web) or Apple In-App Purchases (iOS app)
• Subscriptions automatically renew unless cancelled before the renewal date
• You can cancel your subscription at any time through the Settings page or Stripe customer portal
• No refunds for partial billing periods, except as described in our 30-day guarantee

5a. Fair Use Policy

Pro subscriptions include unlimited reports for normal personal use. "Unlimited" means there is no fixed cap on the number of reports you can generate, but the Service is subject to reasonable fair use limits designed to prevent abuse and ensure quality for all users:

• Up to 30 uploads per day and 15 image parses per hour
• 1 AI-generated season report per week
• Reports are intended for personal analysis of your own betting history

These limits are generous and designed to accommodate even the most active bettors. If you consistently hit these limits through normal use, contact us and we'll work with you. We reserve the right to throttle or suspend accounts that engage in automated, abusive, or commercially exploitative usage patterns (e.g., running a third-party service on top of Fumbled, or using bots to generate bulk reports).

7. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Share your account with others
• Attempt to reverse-engineer, decompile, or disassemble the Service
• Use automated systems (bots, scrapers) to access the Service
• Upload malicious files or attempt to exploit the Service
• Circumvent rate limits, subscription checks, or security measures
• Use the Service to promote or facilitate underage gambling

8. Disclaimer — Not Gambling Advice

Fumbled is a data analysis tool for informational and educational purposes only.

• We do not guarantee profits or predict outcomes of sporting events
• Past performance analysis does not guarantee future results
• Our analysis is based on mathematical models and may contain errors
• We are not licensed as financial advisors, investment advisors, or gambling operators
• You are solely responsible for your betting decisions

9. Intellectual Property

The Service, including its design, algorithms, analytics engine, and content, is owned by Fumbled and protected by copyright and intellectual property laws. Your uploaded betting data remains your property. By uploading data, you grant us a limited license to process it for the purpose of providing the Service.

10. Account Deletion

You may delete your account at any time through the Settings page. Upon deletion, all your personal data, betting history, reports, and support tickets will be permanently removed within 30 days. Active subscriptions will be cancelled.

11. Limitation of Liability

To the maximum extent permitted by law, Fumbled shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

12. Modifications

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting updated Terms on this page. Continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved through binding arbitration.
